What is Probate?
Probate is the whole process of administering an estate when someone dies. In simple terms this involves organising their money, their assets and all liabilities and outstanding debts. Probate also refers to getting permission to carry out the wishes within someones Will.
If there is a Will in place for the deceased, a person will be named named, known as the executor and will follow the wishes stated by the deceased.
Probate is needed before any administration of the deceased’s estate can start.

What is a Grant of Probate?
You will need to apply for a ‘Grant of Probate’ which is a legal document to manage the process of administering an estate if you are the named executor in the Will. This is needed in order to access bank accounts, sell assets and settle debts after someone has died.
The process is not always as straight forward as one would want it to be and is dependent on the size of the estate and often involves a lot of complicated legal, tax and financial work.
Once probate has been granted from a ‘Grant of Probate’ then the estate can start to be distributed.
